3. Nature of the Platform
NovareHealth, through AskMeddy, is a technology platform that connects patients with independent, licensed healthcare providers and offers an AI assistant, Meddy. NovareHealth is a technology company and, for User Content, acts as an intermediary under the Information Technology Act, 2000.
NovareHealth is NOT a healthcare provider, does not practise medicine, does not deliver clinical care and does not interfere with the clinical judgment of any Clinician. NovareHealth's role is limited to providing the technology that facilitates access to Clinicians and to health-information services.
Any clinical relationship is formed solely between the Patient and the independent Clinician. NovareHealth is not a party to that relationship and is not liable for the acts, omissions, diagnoses, prescriptions or treatments of Clinicians.
4. Not for emergencies
AskMeddy is NOT intended for medical emergencies. The Platform is not designed for life-threatening situations and does not guarantee immediate responses.
If you believe you are facing a medical emergency, dial 112 (the national emergency number in India) immediately or go to the nearest emergency service. Do not use AskMeddy or wait for a response from Meddy or a Clinician in an emergency.
5. Eligibility and accounts
To use the Platform, you must be at least 18 years old or use the account under the supervision of a responsible adult. Minors may only be represented by a legal guardian.
When creating an account, you agree to:
- provide truthful, accurate, current and complete information;
- keep your access credentials confidential;
- be solely responsible for all activity carried out under your account;
- notify us immediately of any unauthorised use;
- maintain only one personal account, unless expressly authorised.
We may suspend or close accounts that contain false information or that breach these Terms.
Minors (under 18) — in plain language: if you are under 18, you cannot create your own account. Your parent or legal guardian can add you as a family member on their account, book appointments for you and keep your health information to look after you.
- whoever adds a minor must confirm they are that child's parent or legal guardian — and that confirmation is recorded;
- the minor's health information is viewed and managed by the guardian, always in the minor's best interest;
- at 18 you can create your own account; if anything is unclear, ask a responsible adult for help or contact us.
6. Role of Clinicians
Clinicians available through the Platform are independent professionals, responsible for their own clinical judgment, licensing and compliance with applicable professional standards.
In India, teleconsultations are led by a Registered Medical Practitioner and are conducted in accordance with the Telemedicine Practice Guidelines, 2020 issued under the Indian Medical Council framework.
NovareHealth does not control and is not responsible for the quality, suitability or outcome of any clinical care provided by a Clinician. All diagnostic, therapeutic and prescribing decisions are the sole responsibility of the Registered Medical Practitioner.
7. Teleconsultations and technical limitations
Teleconsultations depend on technical factors outside NovareHealth's control, including the quality of the internet connection, the user's device and network availability.
In line with the Telemedicine Practice Guidelines, 2020, teleconsultation may not be suitable for all clinical conditions. The Registered Medical Practitioner may determine, at their discretion, that an in-person examination, further tests or a referral is required. You must follow such guidance.
NovareHealth does not guarantee the uninterrupted continuity of any Teleconsultation and is not liable for connectivity failures, loss of audio or video, or the inability to hold the consultation for technical reasons.
8. The AI assistant Meddy
Meddy is an artificial-intelligence health assistant provided for informational and decision-support purposes only. Meddy does NOT make diagnoses, does not prescribe treatments and does not form any doctor-patient relationship.
Meddy's responses may contain errors or inaccuracies and are not a substitute for assessment by a Registered Medical Practitioner. You should always verify any health information with a qualified clinician before making decisions.
NovareHealth is not responsible for decisions made solely on the basis of Meddy's responses.
Some Meddy features may rely on third-party medical foundation models (for example, Google's MedGemma, made available under Google's Health AI Developer Foundations terms). Outputs from these models are preliminary, are intended solely for decision support reviewed by a licensed Clinician, and their use is subject to the use restrictions of those terms, including the prohibition on autonomous diagnosis or the unlicensed practice of medicine.
9. Acceptable use and prohibited conduct
You agree to use the Platform lawfully and responsibly, in compliance with the Information Technology Act, 2000 and the rules made thereunder. The following are prohibited, in particular:
- providing false information or impersonating another person;
- using the Platform for unlawful, fraudulent or harmful purposes;
- uploading malicious content, viruses or code intended to compromise the Platform;
- attempting to access accounts, data or systems without authorisation;
- extracting, copying or reusing Platform content without permission;
- harassing, threatening or disrespecting Clinicians or other users;
- interfering with the normal operation of the Platform.
10. User content and health records
You own your data and health records. By uploading User Content, you grant NovareHealth a limited, non-exclusive, revocable licence to process, store and transmit that content solely to provide and improve the Platform's services, including sharing it with the Clinicians you choose.
This licence does not transfer ownership of your data. NovareHealth acts as an intermediary in respect of User Content under the Information Technology Act, 2000. The processing of personal and health data is governed by the Privacy Policy.
You are responsible for the accuracy of the information you upload and warrant that you have the right to share it.
11. Fees, billing and payments
Certain Platform services, including Teleconsultations and catalogue products, may be subject to fees, shown before confirmation. Prices are stated in the applicable local currency.
Payments are processed through third-party payment providers. You authorise the charging of amounts due for the services you purchase.
Cancellations and refunds are governed by the Cancellation & Refund Policy, which forms an integral part of these Terms. Consumer rights are protected under the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules made thereunder.
12. Intellectual property
The Platform, including the software, the AskMeddy brand, the NovareHealth brand, the Meddy assistant, text, graphics and their arrangement, is owned by NovareHealth or its licensors and is protected by intellectual-property rights.
You are granted a personal, limited, non-transferable and revocable licence to use the Platform in accordance with these Terms. No intellectual-property rights are transferred to you.
13. Third-party services
The Platform may integrate with or link to third-party services, such as payment processors, video-call providers, delivery services or laboratories. Use of those services is subject to their respective terms and policies.
NovareHealth does not control and is not responsible for the content, availability or practices of third-party services.
14. Privacy
The processing of your personal and health data is described in the Privacy Policy, which forms an integral part of these Terms. We recommend you read it carefully to understand how we collect, use and protect your data.
15. Disclaimer of warranties
The Platform is provided "as is" and "as available", without warranties of any kind, express or implied, to the maximum extent permitted by applicable law.
NovareHealth does not warrant that the Platform will be uninterrupted, error-free, secure or fit for a particular purpose, nor does it warrant the accuracy of Meddy's responses or the availability of any Clinician.
Nothing in these Terms excludes rights that cannot lawfully be excluded under the Consumer Protection Act, 2019.
16. Limitation of liability
To the maximum extent permitted by applicable law, NovareHealth shall not be liable for any indirect, incidental, special, consequential or punitive damages, nor for loss of data, lost profits or loss of opportunity, arising from the use of or inability to use the Platform.
NovareHealth is not responsible for the clinical care provided by independent Clinicians or for decisions made on the basis of Meddy's responses. Clinical responsibility lies solely with the Registered Medical Practitioner.
This limitation does not affect mandatory consumer rights that cannot be excluded under the Consumer Protection Act, 2019.
17. Indemnification
You agree to indemnify and hold harmless NovareHealth, its directors, employees and partners from any claims, damages, losses and expenses (including reasonable fees) arising from your use of the Platform, your breach of these Terms or your violation of third-party rights.
18. Suspension and termination
We may suspend or terminate your access to the Platform, with or without prior notice, in the event of a breach of these Terms, a security risk or a legal requirement.
You may close your account at any time. Provisions that by their nature should survive will remain in force after termination.
19. Changes to the service and Terms
NovareHealth may modify, suspend or discontinue features of the Platform at any time. We may also update these Terms; material changes will be communicated through the Platform or by other reasonable means.
Continued use after the changes take effect constitutes acceptance of the revised Terms.
20. Governing law, jurisdiction and dispute resolution
These Terms are governed by the laws of India. Any disputes shall be submitted to the jurisdiction of the courts at Bengaluru, India, without prejudice to mandatory consumer rights under the Consumer Protection Act, 2019.
The parties shall seek to resolve any dispute in good faith and amicably before resorting to the courts.
